1Acceptance of Terms

Welcome to Simple Mobile (referred to as "Simple Mobile", "we", "our", or "us"), operated by Bina Aset Digital (Registration No. 202601000000). By accessing our website, platform, application programming interfaces (APIs), mobile applications, merchant workspaces, or by signing in via TikTok Login / TikTok OAuth or our authentication services, you ("User", "Merchant", "Operator", "Agent", or "Partner") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our services. If you are entering into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity.

2Description of Services

Simple Mobile provides a multi-tenant cloud operations platform for telecommunication inventory, physical SIM and eSIM fulfillment, automated ICCID scanning and tracking, courier proofing, TikTok Shop merchant integrations, customer messaging, and telco commission reconciliation.

• eSIM & Physical SIM Fulfillment: Real-time activation code (LPA/SM-DP+) storage, carrier QR generation, and order barcode matching.
• TikTok Shop & Social Commerce Integrations: Order synchronization, customer service routing, affiliate creator tracking, and inventory availability APIs.
• Merchant & Agent Workspaces: Role-based access control, commission reporting, and order status portals.

3TikTok Login and Third-Party Integrations

When you use TikTok Login, TikTok Shop Open API, or link your TikTok merchant/creator account with Simple Mobile:

• You authorize Simple Mobile to access the scopes and permissions you explicitly consent to, including profile identification, store management, and order details strictly necessary for fulfillment and customer service.
• You agree to comply with TikTok's Developer Terms of Service, TikTok Shop Merchant Agreements, and TikTok Community Guidelines.
• We only utilize authorized APIs and data points provided through official developer channels. We do not store or solicit your TikTok passwords.
• You can revoke our application's access at any time via your TikTok account security settings or through your Simple Mobile workspace settings.

4User Accounts, Security, and Global Access

You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your credentials or breach of security.

Our services are available globally. You represent and warrant that you will not use our platform in violation of any applicable export controls, sanctions, or local communications regulations in your jurisdiction.

5Acceptable Use Policy

You agree not to:

• Use the platform for fraudulent SIM registration, spam transmission, or unauthorized automated scrapping;
• Reverse engineer, decompile, or tamper with eSIM QR generation algorithms or system endpoints;
• Infringe upon intellectual property, privacy, or statutory rights of third parties or carrier partners (e.g. Halo Telco, Vibe Mobile, Tune Talk);
• Attempt to gain unauthorized access to any other tenant's data or infrastructure.

6Data Protection & Confidentiality

We treat buyer and merchant information with high confidentiality and security standards. Order details, phone numbers (MSISDN), identity documents (IC/Passports for SIM registration compliance), and tracking identifiers are processed according to our Privacy Policy and relevant telecommunications compliance frameworks (including Malaysia Personal Data Protection Act 2010 and global privacy equivalents).

7Disclaimer of Warranties & Limitation of Liability

Simple Mobile services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Carrier network connectivity, cellular signal coverage, telecommunication plan speeds, and third-party platform API uptime (including TikTok Shop or WhatsApp Business) depend on third-party service providers.

To the fullest extent permitted by applicable law, Simple Mobile and Bina Aset Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill resulting from your access to or inability to use the services.

8Modifications and Governing Law

We reserve the right to modify these Terms at any time. When changes occur, we will update the "Last updated" date on this page. Your continued use of the platform following the posting of revised Terms means you accept and agree to the changes.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles. Any legal dispute shall be subject to the exclusive jurisdiction of the competent courts in Malaysia.
